These Terms apply to services provided by True North Chimney Care anywhere in Canada. By booking, you agree to these conditions. If you prefer a simplified overview, use the “Show plain-language” button above.
Bookings may be made by telephone or electronic means. Acceptance occurs when we issue written confirmation (including email/SMS). Appointment windows are estimates. We may, acting reasonably, reschedule or modify service timing for safety, weather, access, traffic, or staffing. We will notify you as soon as practicable and offer the next available time. If we cannot reach you, we may pause the booking until we receive instructions.
You may cancel or reschedule without charge if we receive at least 24 hours’ notice before the start of the appointment window. Late changes or failure to provide access may incur a reasonable call-out or late-cancellation fee representing travel and scheduling costs. If we are late by more than 60 minutes without prior notice, you may reschedule without penalty.
You are responsible for providing clear, safe access to the work area, including ladders, roof, and interior spaces. We may decline or pause work if, in our professional judgment, conditions are unsafe or non-compliant. We follow applicable Canadian codes and best practices, including provincial occupational health and safety requirements. Pets should be secured, and combustibles removed from the work area.
Unless stated otherwise, estimates are non-binding and based on information you provide. If we uncover additional issues (e.g., blockages, damaged liners), we will provide a revised quotation for your approval before proceeding. Prices are in Canadian dollars and may be subject to applicable taxes. Payment is due upon completion unless we agree otherwise in writing. Accepted methods include major cards and Interac e-Transfer.
Our services include inspection, cleaning, minor adjustments, and practical recommendations. Unless expressly stated, we do not certify structural integrity, prior workmanship, or code compliance of existing installations. Any recommendations are based on observable conditions at the time of service. Performance of third-party components or materials is the responsibility of their respective manufacturers or installers.
We warrant that services will be performed with reasonable skill and care consistent with Canadian industry standards. If notified within 30 days, we will, at our option, re-perform the affected portion or provide a reasonable refund. This warranty does not cover misuse, neglect, subsequent alterations, or conditions outside our control.
To the maximum extent permitted by applicable Canadian law, we are not liable for indirect, incidental, special, or consequential damages, loss of profit, or loss of use. Our aggregate liability arising from the services is limited to the amount you paid for the specific service giving rise to the claim. Nothing in these Terms limits liability for death or personal injury caused by negligence, or for fraud. You agree to indemnify us for claims arising from your breach of these Terms or failure to provide safe access, except to the extent caused by our negligence.
We may collect photographic or written records of observed conditions solely to document work, support recommendations, and maintain internal quality assurance. We will not publish images that identify you or your property without consent, except where disclosure is required by law or for insurance purposes.
We handle personal information in accordance with applicable Canadian privacy laws. We collect only what is necessary to provide and improve services (e.g., contact details, service history). Cookies may be used for preferences, analytics, and security. Non-essential cookies are optional and can be declined via the banner. For details or access requests, contact us using the information below.
We are not responsible for delays or failures caused by events beyond our reasonable control, including severe weather, natural disasters, public emergencies, strikes, utility failures, or government actions. We will notify you where practicable and resume performance promptly when the event subsides.
These Terms are governed by the laws of Canada and the province or territory where the service is performed, without regard to conflict-of-laws rules. Parties will attempt to resolve disputes amicably within 30 days of notice. Subject to applicable consumer protection statutes, proceedings may be brought in the courts of that province or territory.
We may amend these Terms from time to time. Changes become effective when posted on this page and will apply to bookings made after the effective date. Material changes will be highlighted for a reasonable period.
